Les Trois Enfants Terms of Trade
All orders for goods ("Goods") made by You ("You"/"Your") and accepted by Les Trois Enfants Ltd ("We"/"Us"/"Our") through the Les Trois Enfants website (the "Site") are subject exclusively and strictly to the relevant section(s) of these Terms of Trade as indicated below and prevail over any other terms and conditions or other contracts with Us in the event of any inconsistency.
1. Ordering and Registration
1.1 All orders for Goods made by You through the Site are subject to acceptance by Us. We may choose not to accept Your order for any reason.
1.2 If the Goods You have ordered are not available from stock We reserve the right to wait until the Goods are available from stock before We supply You; or
1.3 We may choose to subject Your order details to additional security checks after You have submitted Your order and, depending on the outcome of these enquires, We may decide to cancel Your order.
1.4 You will need to register on the Site to be able to place an order. Upon registration, You will select a Password and User Name that You can use to access Your Account. You are responsible for maintaining the confidentiality of Your Password and User Name and are responsible for all activities that occur under them. We do not have the means to check the identity of people using the Site and will not be liable where Your Password or User Name are used by someone else. You agree to notify Us immediately of any unauthorised use of Your Password or User Name or any other breach of security of which You become aware.
2. Description of Goods and Prices
2.1 Prices that are reduced for sales and promotions are only valid for orders placed by You within the specified period.
2.2 After We receive Your order, We will, without undue delay, acknowledge receipt and confirm the details, description and price for the items by email.
2.3 We will use reasonable endeavours to ensure that all details, descriptions and prices for the Goods appearing on the Site are correct at the time when the information was inputted. We reserve the right to adjust the price and specification of any item on the Site before placement of orders at Our discretion, and without notifying You individually.
We reserve the right to withdraw any items from the Site at any time.
2.4 We will not be liable to You or anyone else for withdrawing any items from the Site or refusing to process an order.
3. Age of consent
3.1 You must be 18 years of age or older to order Goods from the Site. If We discover that You do not comply with this age requirement We reserve the right to terminate all account facilities immediately, without notice, and We will not be obliged to complete the order.
4. Payment & VAT
The total cost of Your order is the price of the Goods plus card processing charges plus delivery charges (as detailed when You place Your order), and confirmed to You via Your ‘Order Confirmation’ email.
4.1 Payment can be made by most major credit or debit cards in accordance with the Payment Methods section. Payment for Goods will be debited from Your account upon despatch of the Goods to You where You do so.
4.2 We will only accept orders for Goods where the card being used is registered to a UK address.
4.3 You agree that the credit/debit card that is being used is yours. All credit/debit card holders are subject to validation checks and authorisation by the card issuer. If the issuer of Your card refuses to authorise payment, or We or Our authorised agents are unable to contact Your card issuer, We will not be liable for any delay or non-delivery and We are not obliged to inform You of the refusal.
4.4 We are not responsible for Your card issuer or bank charging You as a result of Our processing of Your credit/debit card payment.
4.5 The price for the Goods as set on the Site includes VAT for EU deliveries. We are not responsible for any other importation taxes, sales taxes or charges that may be levied at the delivery destination. We are not obliged to provide printed or written VAT receipts on demand.
5. Delivery & Risk
5.1 We despatch items ordered by You when they are available using reputable carriers First Class Royal Mail in the UK and Airmail or Express Carrier (as specified by You) outside of the UK.
5.2 Goods orders will be sent to the delivery address indicated at the time You confirm Your order. We cannot be held responsible if this delivery address is unsuitable for You or the wrong details have been given. If You wish to cancel an order We must receive notice before We email You Our order confirmation. It is not possible to change the delivery address of an item after We have confirmed Your order, but You may cancel Your order as explained in clause 6.
5.3 We do not accept any liability for late deliveries or deliveries lost in the postor deliveries lost in the post. We shall use our reasonable endeavors to deliver the Goods to you within 10 days (within the UK), unless we inform you otherwise by email. Please see our shipping details for further information.
5.4 Once the Goods have been received by You, all risk of damage to, or loss of, the goods shall pass to You. If You intend to cancel Your order You must keep good care of the Goods pending their return to Us. We reserve the right to refuse refunds in cases of excessive returns, or to offer part refunds based on the cost to Us of processing excessive returns.
5.5 We will retain title in all Our Goods until sums due or that become due to Us from You in respect of any order have been paid in full.
6. Returning your Goods
You may cancel Your order any time between placing Your order on the Site and seven working days beginning with the day after the date of delivery of the Goods to benefit from this right, You must take reasonable care of Your Goods by which We assume You will not cut out labels, or tags or washing instructions and will return Goods. If You choose to cancel, You must send Us written notice to this effect, which can be by email, fax or letter (see below for contact details). Upon receiving Your written notice to cancel, We will refund all monies paid by or on behalf of You for the Goods as soon as possible, and in any event within 30 days.
6.1 If You cancel Your order, You must return the Goods to Us. If You do not, We can and will charge You the direct cost to Us of recovering the Goods.
6.2 If You cancel Your order under 6.1, You are responsible for the costs of returning the Goods to Us and at Your risk. We therefore recommend that you consider insuring Goods for their full value when returning items.
6.3 You must take care of the Goods until they are returned to Us. If You do not, We may claim against You for the resulting loss in value. We may also charge You for Our reasonable charges (including legal and administrative costs) incurred in reclaiming the Goods from You where You cancel an Order but fail to return them to Us.
6.4 You will not be able to obtain a refund of Goods or other charges where You fail to cancel in accordance with this clause 6 unless there is a fault in the Goods.
7. Limitation of liability
7.1 To the fullest extent permissible under law, We disclaim any and all promises in relation to Goods purchased by You through the Site. Your statutory rights as a consumer are not affected however including Your right to receive Goods that are fit for purpose and conform to the description given and Your right to receive a reasonable standard of service .
7.2 We shall not be liable to You in contract, tort (including negligence), for breach of statutory duty or in any other way for:
7.2.1 any economic loss, loss arising from or in connection with loss of revenues, profits, contracts or business or failure to realise anticipated savings;
7.2.2 any loss of goodwill or reputation; or
7.2.3 any indirect or consequential losses
suffered or incurred by You.
7.3 Our aggregate liability in respect of any loss or damage suffered or incurred by You and arising out of or in connection with these Terms of Trade, whether in contract, negligence, breach of statutory duty, or in any other way shall be limited to the price of the Goods paid by You to Us in order to purchase the Goods to which Our liability relates.
7.4 Nothing in these Terms of Trade shall exclude or limit Our liability for death or personal injury resulting from Our negligence or fraud or the negligence or fraud of Our agents or employees.
8. Changes to these terms of trade
We may change these Terms and Conditions of Trade at any time and will publish their replacement on this Site and notify You by email of any material changes.
9. Severance
9.1 If any provision of these Terms of Trade shall be found by any court or administrative body of competent jurisdiction to be invalid or unenforceable, such invalidity or unenforceability shall not affect the other provisions of these Terms of Trade which shall remain in full force and effect.
10. Law and jurisdiction
These terms shall be governed by and interpreted in accordance with the laws of England (or the laws of Scotland if You are domiciled there). Disputes arising in connection with these terms shall be subject to the exclusive jurisdiction of the courts of England and Wales unless You choose the jurisdiction of Your domicile in Scotland or Northern Ireland.
11. Force majeure
11.1 In these Terms of Trade, "force majeure" shall mean any cause preventing Us from performing any or all of Our obligations which arises or are attributable to strikes, lock-outs or other industrial disputes, nuclear accident or acts of God, war or terrorist activity, riot, civil commotion, malicious damage, compliance with any law or government order, rule regulation or direction, accident breakdown of plant or machinery, fire, flood, storm or default of suppliers, and where they are beyond Our reasonable control, any other acts, events, omissions or accidents.
11.2 If We are prevented from performing Our obligations under these Terms of Trade by force majeure, We shall as soon as reasonably possible send You an email specifying the nature and extent of the circumstances giving rise to force majeure, and shall subject to service, have no liability in respect of any non-performance or delayed performance of Our obligations provided that We have used reasonable endeavours to mitigate the effect of the force majeure and to carry on Our obligations under these Terms of Trade in any other way that is reasonably practicable.
11.3 If We are prevented from performance of Our obligations to You by force majeure for a continuous period of three months or more, You may terminate the contract for sale incorporating these Terms of Trade on service of written notice upon Us, in which case neither You nor Us will have any liability to the other party except that rights and liabilities which accrued prior to such termination shall continue to subsist.

6.3 Whilst We use all reasonable endeavours to correct any errors or omissions as soon as practicable once they have been brought to Our attention, We do not promise that the information on the Site will be free from errors or omissions and do not promise that the Site will be available uninterrupted and in a fully operating condition.
